Your views: Motor Vehicle Block Exemption Regulations

The European Commission is seeking feedback on its review of the Motor Vehicle Block Exemption regulations.

The regulations are key for members as they protect leasing and rental companies’ status as the ‘end user' – which means customer details can be kept confidential.

The regulations also help to preserve vehicle owners' freedom of choice in getting their vehicles repaired, service and maintained, whether it is with a franchised dealer, brand specialist or independent garage.

The current exemption expires on 31 May 2023 and the European Commission is carrying out an evaluation to check whether the exemption is still effective, efficient, and consistent with other EU and national rules.

In relation to Brexit, under the European Union (Withdrawal) Act 2018, EU law as it stands at the point of Brexit will be converted into UK law. That means that the two block exemptions relevant to the automotive sector will remain in force under UK domestic law until their respective EU expiry dates.

The Commission is seeking views by 19 March 2019.
