This table highlights the current inconsistencies in road traffic legislation which prevent members from transferring liability for fines, regardless of the type of road traffic offences.
One of the repercussions of the legislative defects is that members whose agreements are less than six months in duration are unable to transfer liability for bus lane offences in London. The Government is aware of this and the legal and policy department will continue to lobby to get this changed.
As an interim procedure we have secured a Memorandum of Understanding which gives Members 28 days to pay at the discounted rate rather than the normal 14 days. If you would like to take advantage of this extended discounted period please send your payment with the extra time bus lane letter.
The Protection of Freedoms Act, has now been approved by Parliament and will ban clamping on private land from 1 October 2012. Successful lobbying by the BVRLA has ensured that vehicle rental and leasing companies will retain the ability to have private parking fines transferred to the customers who incur them. The BVRLA will now be working with the British Parking Association to ensure that customers' details can be passed to private parking firms in a simple way, without the need for complex evidential requirements such as copies of rental and lease agreements.
